These Terms of Service ("Terms") govern your use of the services provided by Mastpost LLC ("Mastpost," "we," "us," or "our"). By signing up for or using our services, you ("you," "your," or the "Customer") agree to these Terms. Please read them — they're written in plain English on purpose.

1. What we do

Mastpost provides done-for-you local marketing services, which may include Google Business Profile management, review management, directory citations, local search ranking work, website creation or optimization, content, and related services, depending on your plan and add-ons. We perform these services using commercially reasonable efforts and current best practices.

2. No guarantee of business results

We do not guarantee any particular business outcome — including any specific number of calls, messages, leads, bookings, customers, sales, or revenue. Marketing performance depends on many factors beyond ranking, including your pricing, reviews, responsiveness, market conditions, seasonality, and competition. We commit to doing strong, honest work; we cannot promise results that depend on factors outside the services.

3. Third-party platforms

Our services involve third-party platforms such as Google, Yelp, Facebook, and others. These platforms are independent of Mastpost. We do not control their policies, algorithms, availability, pricing, or decisions (including listing suspensions or content removal). We act on your behalf using the access you grant and in accordance with each platform's rules. We are not responsible or liable for the actions, outages, policy changes, or decisions of any third-party platform.

5. Reviews and content standards

We follow each platform's guidelines. We never buy, fabricate, or incentivize reviews, and we request and respond to reviews only in compliant ways. Review content is written by real customers; we help you earn and respond to it, not manufacture it.

7. Intellectual property

Deliverables we create specifically for you — such as your website, profile content, and the like — are yours to keep once they're paid for. We retain all rights to our own processes, templates, software, systems, and methods. You grant us a license to use the materials you provide (such as your logo and photos) for the purpose of performing the services.

8. Disclaimer of warranties

The services are provided on a commercially reasonable, "as is" basis, and we disclaim all other warranties to the maximum extent permitted by law, including any implied warranties of merchantability or fitness for a particular purpose.

9. Limitation of liability

To the maximum extent permitted by law, Mastpost's total cumulative liability arising out of or relating to the services or these Terms will not exceed the total fees you paid us in the three (3) months immediately before the event giving rise to the claim. We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, or lost business, even if advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless Mastpost from any claims, damages, or expenses arising out of the information, materials, or content you provide to us, your accounts, or your use of the services in violation of these Terms, a platform's rules, or applicable law.

11. Termination

Either party may terminate the relationship as described in Section 6. We may suspend or terminate services for non-payment, misuse, or violation of these Terms. On termination, you keep the deliverables already paid for, and any access you granted us should be removed by you (you can do this at any time).

12. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we'll let you know. Continuing to use the services after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and any dispute will be handled in the courts located in that state.
